These Terms of Service ("Terms") govern your use of the BulkWP platform ("Service"), a SaaS product developed and operated by Rajeshwar Infotech ("Company", "we", "us", or "our"), accessible at https://bulkwp.wamsgsender.co.in.

By accessing or using the Service you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account or using any part of the Service, you confirm that you are at least 18 years old, have the authority to bind yourself or your organisation to these Terms, and agree to comply with all applicable laws and regulations, including the Information Technology Act, 2000 (India) and WhatsApp's Business Policy.

2. Description of Service

BulkWP is a cloud-based WhatsApp marketing and automation platform that enables businesses to:

  • Send bulk WhatsApp campaigns to opted-in contacts
  • Automate chatbot conversations and reply flows
  • Manage customer contacts and chat inboxes
  • Analyse campaign performance and delivery reports
  • Create and manage WhatsApp message templates

3. Account Registration

You must provide accurate, complete, and current information when registering. You are responsible for maintaining the confidentiality of your login credentials. Rajeshwar Infotech is not liable for losses arising from unauthorised use of your account.

4. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited messages (spam) to contacts who have not opted in
  • Violate WhatsApp's Business Policy or Meta's Terms of Service
  • Transmit illegal, harmful, defamatory, or fraudulent content
  • Infringe on the intellectual property rights of any third party
  • Attempt to reverse-engineer, hack, or disrupt the platform

Rajeshwar Infotech reserves the right to suspend or terminate accounts found in violation of these terms without prior notice.

5. WhatsApp API Compliance

The Service is built on the WhatsApp Business API. Your use must comply with Meta's Commerce Policy, WhatsApp Business Policy, and all applicable messaging regulations including the Telecom Commercial Communications Customer Preference Regulations (TCCCPR), 2018 where applicable.

6. Payment and Subscriptions

Subscription fees are billed in advance on a monthly or annual basis as per the selected plan. All fees are non-refundable except as required by law. Rajeshwar Infotech reserves the right to modify pricing with 30 days' notice.

7. Data Security

Rajeshwar Infotech implements industry-standard security measures including encrypted data storage, HTTPS transmission, and access controls to protect your data. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

8. Intellectual Property

All software, content, and branding within the Service are the exclusive property of Rajeshwar Infotech. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your business purposes only.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Rajeshwar Infotech shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

10. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India.

11. Changes to These Terms

Rajeshwar Infotech may update these Terms at any time. We will notify registered users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
